Summary:
ADEQ is in the process of conducting a rulemaking to update and significantly amend rules related to onsite wastewater treatment facilities program (OWTFs or “onsite facilities”), currently found in Title 18, Chapter 9 of the Arizona Administrative Code, pursuant to stakeholder recommendations for regulatory updates to the OWTF permitting program. ADEQ last amended the program in a limited update rulemaking effective June 19, 2023 (see 29 A.A.R. 1023 (May 12, 2023)). The last rulemakings related to OWTFs were in 2001 and 2005 (see generally 7 A.A.R. 237 (Jan. 12, 2001) and 11 A.A.R. 4544 (Nov. 14, 2005), respectively).
The rulemaking is anticipated to greatly benefit the customer and stakeholders by improving clarity and overall customer experience; reducing permitting inefficiencies; easing water supplies through improved technological considerations; better protecting people and the environment from the health and pollution risks associated with onsite facilities; and protecting property interests and values.
