This permit is for stormwater discharges associated with sites of specific mining industry activity, to protected surface waters. Permit eligibility is limited to discharges from facilities of industrial activity in Sectors G and J, based on Standard industrial Classification (SIC) codes and Industrial Activity Codes.
The MSGP is valid for five years. An initial fee is due at the time the operator submits the Notice of Intent (NOI) fee to ADEQ, and is based on the amount of acreage at the site. Permittees must also pay an annual registration fee based on the acreage of their facility, and fees continue until the industrial activity ceases or the facility closes, at which time the operator files a Notice of Termination (NOT) to end coverage.
2019 Mining MSGP - Modified
The 2019 Mining MSGP replaced ADEQ’s 2010 Mining MSGP. The 2019 MSGPs were modified to include non-WOTUS protected surface waters. This modification was necessary in order to incorporate Arizona’s new Surface Water Protection Program (SWPP)1 | Visit SWPP Page >
The MSGP permit modifications became effective Sept. 29, 2021. No action is currently required to maintain coverage if you have an active NOI | Learn More and View Documents >
